CONDITIONS FOR THE USE OF BOONE ROAD CLUB FACILITIES

THE FACILITIES

Will seat approximately 600 persons or can be set up with tables and chairs to accommodate 400 for a meal with space left for dancing. All meals must be catered or pre-prepared.

APPLICATION FOR BUILDING USAGE

All applications must be made through the office of the Business Manager. The damage deposit will be $600.00 for events. The reservation will be placed on the calendar ONLY when these have been received and application has been approved. The balance of the fees is due two months prior to the planned event. Lessee is responsible for meeting this deadline. If the deadline is not met, the Lessor has the right to remove the reservation from the calendar.

SMOKING

No smoking is allowed.

SECURITY OFFICER(S)

Any assigned security officer(s) for the event will be secured by and receive their instructions from the Business Manager's office. The Lessee is required to have police security when alcoholic beverages are being served. The requirements are as follows: 1-150 persons = 2 officers, 151-400 persons = 3 officers, and 401-600 = 4 officers. If it is deemed necessary by either the officer on duty or a staff member, additional security officers will be called in for the event. If this should occur the Lessee will be responsible for the payment of the officers.

DECORATIONS

Nothing, including decorations, may be attached to the walls, ceiling or floor with tape, tacks, brads or nails. All decorations must be on the tables or free standing. If this is violated, full refund of damage deposit is jeopardized.

USAGE - TIME REQUIREMENTS

Use will be limited to one day ending no later than 1:00 a.m. The building must be vacated by 2:00 a.m. Additional decoration time may be scheduled. The building will be opened for you AT THE TIME SPECIFIED IN THIS CONTRACT. If you want to change your opening time call the office.

SET-UP AND CLEAN-UP PROCEDURES

The Lessee is responsible for the setting up of tables and chairs. Proper caution MUST be exercised in setting-up and during event to insure that furniture or floor not be damaged. Such damage is subject to damage deposit forfeit in all or part.

COORDINATOR

A coordinator will be assigned to you. The coordinator should contact you at least 24 hours prior to your use of the facility. If you have not been contacted by Friday morning prior to a weekend event (even though it may be more than 24 hours), it is your responsibility to contract the office for the name and pager number of your assigned coordinator.

OTHER RESPONSILILITIES OF LESSEE

IF keg beer will be served, the keg beer must be served by the Boone Road Club through the serving window. Any server must be certified according to the requirements of the TABC to serve alcoholic beverages. Absolutely no "self-serve". This applies to margarita machines and any other device that dispenses an alcoholic beverage.

Absolutely no confetti, rice, paper, petals, birdseed or any other form of shredded materials may be thrown anywhere inside the hall. Birdseed may be thrown outside of the hall.

Lessee must ensure that food or drinks are not taken outside of the designated usage areas.

Lessee must ensure that people do not drink outside of the designated usage areas. Children should remain with their parents or be supervised and not be allowed to roam the halls or play in the parking lot or grounds.

Lessee is fully responsible for the behavior of all guests.

Lessee's rights hereunder are not assignable and Lessee shall not be entitled to sublet any part of the Lease Facilities. Lessee shall not permit any unlawful, dangerous, flammable or explosive substance on the Leased Facilities.

HOLD HARMLESS

Lessee shall become thoroughly familiar with the Leased Facilities prior to entering into possession hereunder, and accepts the same in their present condition. Boone Road Club shall not be liable to Lessee for any personal injury or property damage in or about the Leased Facilities in the absence of Boone Road Club's gross negligence. Lessee shall indemnify and hold Boone Road Club harmless from and against all liabilities, claims and judgments, including costs and attorney's fees and expenses relating thereto, for personal injury to and death of any person, and for loss of our damage to any property which arises out of, or is in any way connected with Lessee's use of the Leased Facilities, including any personal injury or death, or loss of or damage to property arising out of the concurrent or sole negligence of Boone Road Club.

No verbal understanding or agreement shall be recognized.

FEES AND DEPOSITS

A damage deposit of $600.00 is paid at the time of the contract. This is returned UPON REQUEST two weeks following the use of the facility if there are no damages, rental misrepresentation or failure to comply with rules and guidelines. Renters are required to cover any additional damages or cost of additional security officers that may exceed $600.00. The decision to return none or part of a damage deposit is left entirely to the Business Manager's discretion.

If the facility use is canceled for any reason by the lessee (a) full fee and damage deposit will be returned if cancellation is made prior to three months before rent date; (b) after that none of the rent fee and the full damage deposit will be returned.

POLICY FOR ALCOHOL CONSUMOPTION OF BOONE ROAD CLUB PROPERTY

Christian behavior required both moderation and responsibility in the consumption of alcohol. Boone Road Club hereby establishes the following policy:

1. Alcohol may be consumed on property in the facility scheduled for use at sanctioned functions.
2. Absolutely no minors are to be served alcoholic beverages.
3. Uniformed security officer(s) are required at functions whenever alcoholic beverages are served.
4. Intoxication is not acceptable behavior at any function at Boone Road Club. If intoxication should occur, the host must accept the responsibility for taking the appropriate action in dealing with the situation. (See item 5 below.)
5. No alcoholic beverages shall be brought on to premises by individuals or groups. NO "BYOB".

The above reflects the policy of the Boone Road Club. It does not dictate a personal choice regarding alcohol consumption. It establishes the parameters within which we will function as a Christian community that allows the consumption of alcohol.

When alcohol is being served the following recommendations are made:

1. Food should be served constantly throughout the event.
2. No alcoholic beverages may be brought into the event except those provided by Boone Road Club.
3. All individuals should be observed throughout the event to make sure that are eating and not just drinking.
4. No one who is already intoxicated will be permitted to enter the Boone Road Club.
5. A pre-existing plan should be devised to handle an individual who has had too much to drink. This plan should include:
A. Alternative methods of transpiration home after the event should the individual be in a diminished or incapacitated state and unable to drive their vehicle.
B. A method to limit or stop an individual's consumption should he or she has had too much to drink in the opinion of the coordinator or security officer. (This detection method can be handled through simple observation. If the individual exhibits slurred speech, staggering or poor motor skill coordination, then no more alcohol may be made available to that individual.)
6. No other controlled substance maybe brought onto the property of Boone Road Club.
